By considering the size of the data packet to be transmitted when setting the thresholds used to determine the state of the rate control bit, the increased sensitivity at higher data packet sizes of system stability to an incorrect determination of the state of the rate control bit may be accommodated. Furthermore, when a mobile station is located within a soft handoff area, the number of base stations transmitting rate control bits to the mobile station is considered when setting the variable thresholds.
