Diaphragm-type noise maker/whistling device

The present invention is a novelty item in the form of a noise maker/whistling device designed for the purpose of whistling in a great variety of sounds. It is taken fully into the mouth where it curves smoothly against the roof of the user's mouth. The noise maker is completely concealed from others which adds tremendous surprise. The invention consists of three components that preferably conform to FDA regulations: one or more diaphragm(s), a structural support and a triangular thin round-cornered paper carrier. The diaphragm(s) vibrates when impinged by pulmonary air exhausted by the user. The structural support comprises organic or non-organic material and surrounds the diaphragm(s). The structural support and diaphragm(s) are embodied inside the thin paper carrier. The item also preferably conforms to CPSC and International toy safety laws.

CROSS-REFERENCE TO RELATED APPLICATIONS

This application claims priority to Provisional Patent Application US60/781,357 dated Mar. 28, 2006.

BACKGROUND OF THE INVENTION

1. Field of the Invention

This invention relates to a diaphragm-type noisemaker/whistling device.

2. Background

There are known to exist conventional whistles or whistling devises. Whistles are not capable of being fully hidden in the user's mouth, conventional whistling devices are not capable of being fully hidden in the user's mouth without posing a severe choking hazard.

While turkey callers are also known to exist, known turkey callers do not have a great range, depth, fullness and intensity of sounds. Conventional game callers produce single-tone, a flutter or raspy sound effects while this invention is capable of making whistling sounds reminiscent of singing birds. Besides that conventional oral game callers feel bulky in the mouth their construction is usually surrounded by a plastic encasing onto which cannot be printed with FDA approved inks suitable to be taken into the mouth. The artificial, plastic encasings of conventional game callers doesn't feel natural in the mouth opposed to the thin paper carrier used in this invention.

Moreover, conventional bird callers do not conform to any child toy safety regulations and the great danger exists that a child will swallow or choke due to the small size of such devices. Still further, known bird callers provide a construction that is very rudimentary and worrisome due to an outer, spiked metal ring which can rust.

Therefore, there exists a need in the industry for a novelty item in the form of a noisemaker/whistling gadget that does not suffer from any of the above discussed deficiencies.

SUMMARY OF THE INVENTION

The present invention advantageously fills the aforementioned deficiencies by providing a novelty item in the form of a noisemaker/whistling gadget that can be fully hidden within the mouth of the user, provides a great range, depth, fullness and intensity of sounds, is not bulky, can be printed with FDA approved inks, which will not rust and which is child safe.

In accordance with the present invention a new novelty item in the form of a noisemaker/whistling gadget is provided which is capable of producing complex and loud, intense, high pitched tones comprised of multiple frequencies to simulate a great variety of sounds similar to sounds made by singing birds. Because it can be hidden entirely within the mouth of the user it creates tremendous surprise which makes it so much fun. This fact is relevant because it sets this invention apart from conventional whistles and other not fully hidden oral noise makers.

This invention feels unobtrusive in the mouth because of its size, homogenous design and materials chosen. The specific triangular, round-cornered thin paper carrier in this invention repels moisture while just absorbing enough to effortless shape against the roof of the user's mouth. The paper carrier's slightly textured surface promotes adhesion to the roof of the user's mouth while feeling natural at the same time.

The lightness of this invention makes it very easy and playful to produce sounds. Little force is needed by the tongue to press against the diaphragm(s) to let the outward flow of pulmatory air stream between roof and diaphragm which enables the user to a virtuosity-like quality of producing whistling sounds.

In this invention the constructional embedding of all components is designed to give the thin paper carrier the largest possible display surface in order to create a medium for messages and motifs for all kind of purposes and endeavors transforming this invention from a simple novelty item into a medium for visual communication. Paper, opposed to plastic, is chosen in this invention for comfort to the user but in addition so that inks can be printed onto the paper and a varnish applied. The inks fall within FDA food contact regulation and the varnish conforms to FDA regulation to be taken into the mouth. In addition, the thin paper carrier can be infused with one or multiple flavor(s) and/or scent(s).

The design of this invention is large enough for safe use by children seven years of age and older and it doesn't require a choking hazard warning while complying with the CPSC and International toy safety laws and regulations. In this invention all materials conform to FDA regulations and all shapes are without any sharp or protruding edges or corners. The present invention is also preferably designed and sized so that it conforms to CPSC (U.S. Consumer Product Safety Commission) child toy safety regulations and therefore the invention can be used by children in the United States.

Therefore, it is an object of the present invention to provide a new novelty item in the form of a noisemaker/whistling gadget which is capable of producing complex and loud, intense, high pitched tones comprised of multiple frequencies to simulate a great variety of sounds similar to sounds made by singing birds.

It is a further object of the present invention to provide a new novelty item in the form of a noisemaker/whistling gadget which can be fully hidden within the mouth of the user.

Still further, it is an object of the present invention to provide a new novelty item in the form of a noisemaker/whistling gadget which is designed so that is conforms to any and all CPSC regulations.

Further still, it is an object of the present invention to provide a new novelty item in the form of a noisemaker/whistling gadget which provides a medium for visual communication, a means to display motifs, advertising or messages.

Finally, it is an object of the present invention to provide diaphragm-type noise maker/whistling device that does not suffer from any of the problems or deficiencies associated with the prior art.

The present invention now will be described more fully hereinafter with reference to the accompanying drawings, which are intended to be read in conjunction with both this summary, the detailed description and any preferred and/or particular embodiments specifically discussed or otherwise disclosed. This invention may, however, be embodied in many different forms and should not be construed as limited to the embodiments set forth herein; rather, these embodiments are provided by way of illustration only and so that this disclosure will be thorough, complete and will fully convey the full scope of the invention to those skilled in the art.

DETAILED DESCRIPTION OF THE INVENTION

Referring now to the drawings, this invention provides a novelty item in the form of a noise maker/whistling device as shown in FIG. 1 in which the pressure of the user's tongue controls the diaphragm 2 while exhaling air over the diaphragm 2 and out of the mouth. The baseline of this invention which holds the diaphragm 2 touches the back of the user's upper teeth.

The device includes a triangular, round cornered thin paper carrier 1, an embedded diaphragm 2 which is of organic compound or any other material providing it matches the sound properties of the organic diaphragm used in this invention. The third component, the embedded structural support 3 and 3a, is invisible in the finished device but is shown in FIG. 4 and FIG. 5. Both supports 3 and 3a are used exclusively, not together.

FIG. 1A shows the round cornered thin paper carrier 1 is cut open at it's base line into a centrally positioned half-circle window 1a which exposes the straight vibratory edge of the embedded organic diaphragm 2. The organic compound based diaphragm 2 has a much greater sound range than an artificial diaphragm as used in conventional game callers.

The embedded diaphragm 2 as shown in side view FIG. 2 is thinner than the round cornered sheet-like paper carrier 1 and extends left and right 2a into the paper carrier 1 which holds the diaphragm 2 taunt in place. Unlike known whistling devices and game callers, no other means is needed to hold the diaphragm 2 in place and keep it taunt.

The half-circle window which exposes the diaphragm is also shown in FIG. 3, FIG. 4 and FIG. 5 which illustrate how the two parts of the paper carrier 1 are joint on top of each other with the diaphragm 2 and structural support 3 or 3a embedded between the two sheet-like paper carrier parts 1. The two parts of the paper carrier 1 are joined by an adhesive conforming to FDA regulations. The diaphragm 2 extends horizontally and vertically passed the half-circle window 1a into the thin paper carrier. The covered window 1b is illustrated by a dotted line in FIG. 3, FIG. 4 and FIG. 5.

The embedded pliable C-shape structural support 3 in FIG. 4. is positioned on top or below the diaphragm 2, depending on the assembling process. This C-shape support is not needed to hold the diaphragm 2 in place but is intended and designed to provide horizontal stability and controlled flexibility to the thin paper carrier 1. The C-shape support 3 makes the paper carrier capable of being bent lightly by the user and then keeps that particular set curvature withholding the pressure of the user's tongue. The materials for the C-shape support 3 vary from a thin non-rusting metal compound as used in medical facilities to plastic with the goal in mind to keep the pliable C-shape support 3 as thin as possible.

In addition the C-shape structural support 3 can be made of a plastic compound that is already curved in a pre-set position fitting preferably the average user's roof of the mouth. The pre-set position withholds the pressure of the preferably average user's tongue. Each afore mentioned material is used exclusively and not combined with the others.

FIG. 5 shows the structural support area 3a which can be applied to this invention instead of the pliable C-shape structural support. This principle also shows that no support is needed to hold the diaphragm in place except the embedding into the paper carrier. The structural support area 3a is made of one or multiple compound(s) which conforms to FDA regulations and is/are saturated into the paper carrier 1 illustrated by the indicated area 3a. This substance(s) curves the paper carrier 1 into a set position when said substance(s) comes in contact with moisture and hardens pre-set position to withhold the pressure of the preferably average user's tongue

FIG. 6 shows the final curved shape of the noise maker/whistling device. It's size and shape conforms to the small parts measurement requirements of the CPSC for not posing a choking hazard to children under the age of three.

As the inventor it is important for me to reiterate that in this invention not only the organic membrane(s) produces superior results in sound making than conventional game callers and that the design, size and materials make it very comfortable for the user but that the invention itself transforms from merely being a thing, novelty item into a media medium such as a page in a magazine is, a house wall for an advertising display, a bill board, an actual TV set or the internet as such. This new novelty item is a communication device.

While the present invention has been described above in terms of specific embodiments, it is to be understood that the invention is not limited to these disclosed embodiments. Many modifications and other embodiments of the invention will come to mind of those skilled in the art to which this invention pertains, and which are intended to be and are covered by both this disclosure and the appended claims. It is indeed intended that the scope of the invention should be determined by proper interpretation and construction of the appended claims and their legal equivalents, as understood by those of skill in the art relying upon the disclosure in this specification and the attached drawings.

Claims

1. A noise maker having components of a size and design suitable to fit fully and hidden against the roof of a user's mouth comprising:

a thin paper carrier,
at least one diaphragm of organic matter embedded into the thin paper carrier,
a structural support embedded into the thin paper carrier

2. The noise maker as claimed in claim 1 wherein said thin paper carrier is suitable to be printed on with FDA conforming inks in all kinds of motifs and typefaces serving various purposes and endeavors.

3. The noise maker as claimed in claim 1 wherein said at least one diaphragm is made of an organic-based compound.

4. The noise maker as claimed in claim 1 wherein said embedded structural support is a pliable C-shape made of metal compound providing user to bend effortless thin paper carrier very little to achieve curvature more applicable to roof in preferably average user's mouth increasing user's ability to produce the greatest range of sounds provided by noise maker/whistling device.

5. The noise maker as claimed in claim 1 wherein said embedded structural support is an area made of at least one substance which conforms to FDA regulations fit for oral usage.

6. The noise maker as claimed in claim 1 wherein said diaphragm(s) and either said structural support are embedded into said thin paper carrier.

7. The noisemaker as claim in claim 2 wherein said thin paper carrier is of a size and design to enable it to be fully concealed in the mouth.

8. The noisemaker as claimed in claim 2 wherein said thin paper carrier has a surface and material to promote a light affixing, adhesion to the roof of the user's mouth.

9. The noisemaker as claimed in claim 2 wherein said thin paper carrier is infused with at least one flavor.

10. The noisemaker as claimed in claim 2 wherein said thin paper carrier is infused with at least one scent.

11. The noisemaker as claimed in claim 2 wherein said at least one embedded organic based diaphragm has a much greater range and variety of sounds than an artificial, prophylactic diaphragm.

12. The noisemaker as claimed in claim 4 wherein said embedded C-shape structural support is made of plastic compound already pre-set with permanent curvature suited for preferably average user's mouth increasing user's ability to produce the greatest range of sounds provided by noise maker/whistling device.

13. The noisemaker as claimed in claim 6 wherein said embedding of all components creates a display area on said thin paper carrier for visual communication.

14. The noisemaker as claimed in claim 13 wherein said display area for visual communication is a visual communications medium.
