Protective Shapewear Device

The present invention relates to a novel padded shapewear garment device. The device comprises a pair of padded pants. The pants are preferably relaxed-fit pants made from a flexible fabric material. The device comprises contoured padding built into the lining of the pants. Typically, the padding is positioned on the buttocks and hip areas of the pants. The padding also offers shaping or shapewear benefits to the user and may encircle the entire hip area. Further, one embodiment of the device comprises a pair of padded pants with side pockets.

CROSS-REFERENCE TO RELATED APPLICATION

The present application claims priority to, and the benefit of, U.S. Provisional Application No. 63/419,751, which was filed on Oct. 27, 2022, and is incorporated herein by reference in its entirety.

FIELD OF THE INVENTION

The present invention relates generally to the field of padded shapewear garment devices. More specifically, the present invention relates to an improved padded shapewear garment device that provides users with a device that protects the hips and buttocks of the user and also provides a shapewear effect. Male padded wear with the same outline may also be developed in a relaxed cargo pant, possibly with a short underneath to hold padding, though the same may not be necessarily “sewn in”. Accordingly, the present disclosure makes specific reference thereto. Nonetheless, it is to be appreciated that aspects of the present invention are also equally applicable to other like applications, devices, and methods of manufacture.

BACKGROUND

By way of background, this invention relates to improvements in padded shapewear garment devices. Generally, falling poses a serious risk for debilitating hip and back injuries, especially for older individuals. In an attempt to avoid such injuries, older individuals may wear padded clothing. However, most padded clothing is bulky and undesirable in appearance.

The present invention relates to pants which contain pads held at locations in the pants to protect the wearer from impact damage at areas likely to suffer significant injury due to falls. The areas to be protected by the padded pants preferably include the hip area and the buttocks. However, the invention additionally contemplates providing pads in the pants at other locations that may suffer from impact. The present invention provides an improved design of padded pants which are capable of protecting body areas prone to injury of the user. The elderly are more prone to impact injury than most other people. But, the use of these pants is not limited to the elderly.

Therefore, there exists a long-felt need in the art for a padded shapewear garment device that provides users with an improved padded garment without the bulk. There is also a long-felt need in the art for a padded shapewear garment device that protects the hips and buttocks of the user from falls. Further, there is a long-felt need in the art for a padded shapewear garment device that protects the hips and buttocks of the users and is discrete and stylish in appearance. Moreover, there is a long-felt need in the art for a device that protects the hips and buttocks of the user and also provides a shapewear effect to the user. Further, there is a long-felt need in the art for a padded shapewear garment device that provides a garment with contoured padding built into the interior of the pants. Finally, there is a long-felt need in the art for a padded shapewear garment device that also includes side pockets.

The subject matter disclosed and claimed herein, in one embodiment thereof, comprises a padded shapewear garment device. The device is comprised of a padded shapewear garment. The device comprises a pair of padded pants. The pants are preferably relaxed-fit pants made from a flexible fabric material. The device comprises contoured padding built into the lining of the pants. Typically, the padding is positioned on the buttocks and hip areas of the pants. The padding also offers shaping or shapewear benefits to the user and may encircle the entire hip area. Further, one embodiment of the device comprises a pair of padded pants with side pockets.

In this manner, the padded shapewear garment device of the present invention accomplishes all of the foregoing objectives and provides users with a device that protects the hips and buttocks of a user and also provides a shapewear effect. The device protects the hips and buttocks of a user without the bulk. The device can be manufactured in multiple designs and styles based on a user's preferences.

SUMMARY OF THE INVENTION

The following presents a simplified summary in order to provide a basic understanding of some aspects of the disclosed innovation. This summary is not an extensive overview, and it is not intended to identify key/critical elements or to delineate the scope thereof. Its sole purpose is to present some general concepts in a simplified form as a prelude to the more detailed description that is presented later.

The subject matter disclosed and claimed herein, in one embodiment thereof, comprises a padded shapewear garment device. The device is comprised of a padded shapewear garment. The device comprises a pair of padded pants. The pants are preferably relaxed-fit pants made from a flexible fabric material. The device comprises contoured padding built into the lining of the pants. Typically, the padding is positioned on the buttocks and hip areas of the pants. The padding also offers shaping or shapewear benefits to the user and may encircle the entire hip area.

The intention of this invention is to provide a garment with compact and contoured cushioning/padding and shaping and/or shapewear around the hips and buttocks of a user, which is built into the interior of the pants garment. The exterior of the garment will, in most cases, look like any other pair of pants. Styling embellishments will serve as decoration only. The inner construction of the contoured padding and shapewear will remain the focus of the invention.

In one embodiment, the pair of pants comprises a front side, a back side, a top, a bottom, an interior and an exterior. The top of the pair of pants comprises an opening for a user to insert their legs and pull up the pants around their waist and a zipper. Specifically, the pair of pants has a hip region, and the top of the pants may be elastic to hold the pants up. In one embodiment, there may be a drawstring at the top of the pants for securing them or a button and zippered fly. Alternatively, a belt or suspenders or the like may be used.

In one embodiment, the bottom of the pants comprise a pair of leg openings for a user to insert their legs during use. The leg openings can be any suitable size as is known in the art, and can be boot cut, straight leg, flared, tapered, etc., depending on the needs and/or wants of a user. The leg opening can be cropped, capri-length, floor-length, ⅞th length, ankle-length, etc.

In one embodiment, any suitable designs and/or embellishments can be utilized as is known in the art, such as stripes, polka dots, chevron, flowers, lace, etc. The styles of the pants will change with the seasons but this will have no bearing on the invention, as the state of the art of the invention remains constant.

In another embodiment, respective hip or side pockets are located circumferentially around the hip regions of the pants and are attached at the hip regions. Each hip region pocket has a bottom end secured to a respective pant leg and has a respective top end secured at the hip regions or waistband. Each hip region pocket has a respective opening at its top end.

In one embodiment, the contoured padding is strategically positioned in the interior of the pants and stitched using flatlock stitching into the inside of the hips and buttocks area of a user. The thickness of the contoured padding will vary, as different areas of the padding will have different thicknesses, based on positioning of the padding within the garment. For example, the contoured padding would be thickest right at the base of the hips and then thin out as the padding goes down the user's leg.

Specifically, the contoured hip padding is shaped to rest on and to protect the hip areas and is shaped to provide such support as to diffuse impact over the entire hip areas and thereby minimize damage or injury to the user.

The contoured padding selected for the preferred illustrated pair of padded pants are any padding that will provide suitable protection. In a preferred embodiment, a military grade silicone rubber is available commercially and recommended, but not required that such material be used to form the padding. Other shapes and sizes of the padding may be selected for a particular user or by a manufacturer.

In one embodiment, the contoured padding is sandwiched between two layers of fabric, which has four-way stretch, is breathable, washable, and compatible with the fabric that is used to manufacture the pants, i.e., cotton/spandex, cotton/lycra, etc.

In one embodiment, the pants can include inserts that are filled with gel, air, foam, or other material to create a padded area. The padded areas may be placed in several locations throughout the garment. These areas are considered to be where stress/force is applied to body parts, such as the knees, buttocks, and hips. The inserts may be sewn/attached to the interior of the garment and may not be visible on the exterior. The exact specifications may vary.

In one embodiment, the garment includes a plurality of pockets located on the interior-surface of the garment, the plurality of pockets are strategically placed on the garment such that padded inserts can be inserted into the plurality of pockets. The garment holds the at least one padded insert against the targeted area of the body of the user/wearer. The at least one padded insert is concealed within the garment. The inner-surface is adjacent to the body of the user/wearer during an in-use condition.

The at least one padded insert may be comprised of a gel, air-padding, foam or other suitable form of padding, and minimizes friction on the targeted area of the body. The at least one padded insert further comprises a substantially similar profile to a respective one of the plurality of pockets, such that the at least one padded insert friction fits within one of the plurality of pockets to minimize relative movement between the at least one padded insert and the respective one of the plurality of pockets. Each of the at least one padded insert is friction fit and compressed within a corresponding one of the plurality of pockets during the in-use condition. The at least one padded insert may be removeable or fastened via fastening means to the inner surface, as well. The fastening means may include sewing or other suitable fastening means as is known in the art.

In one embodiment, the pair of pants also comprises a unique geometric construction and includes a plurality of layers that may vary in shape or compression strength. Specifically, the pair of pants is made from multiple overlapping layers of at least one elastic or stretchable material and includes a plurality of seams which attach the multiple layers along the seams, thereby defining the compression areas.

Any combination of suitable elastic and/or stretchable material(s) may be used to form the multilayer body. By being elastic or stretchable, the material is capable of stretching at least in a longitudinal direction when a force is applied to a portion of a wearer's body weight, while also being able to recover and/or return to the original shape and/or configuration when the force is removed. In some embodiments, the materials that form the main body of the shapewear garment may include, but not be limited to, sheets of polyamides, including nylon, and polyester-polyurethanes, such as spandex, and combinations thereof.

In some embodiments, the body may include multiple layers of the same material, i.e., polyamide, polyester-polyurethane, nylon, spandex, and/or combinations thereof. In other embodiments, the body includes multiple layers of different materials, i.e., a first layer of nylon and a second layer of spandex and/or a first layer of a nylon/spandex blend having a first concentration of nylon, and second layer of a nylon/spandex blend having a different concentration of nylon.

After the pants are put on, the pants can be worn in their normal condition and the presence of the contoured pads and shapewear is not readily visible, due to the appropriate shaping and contour of the pads. Thus, the pants may have the appearance of conventional pants without padding or shapewear, as the padding and shapewear is contoured to the shape of the pants.

In addition, the pair of pants may be available in any size as defined by standardized sizing systems or catalog sizes, and usually denoted on a tag or label affixed to garments that are sold off-the-shelf. In the United States, garment sizes are typically denoted numerically (i.e., 0, 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 22, 24, etc.) or alphabetically (i.e., extra-small (XS), small (S), medium (M), large (L), extra-large (XL), double extra-large (XXL), triple extra-large (XXXL), etc.). Sizes may also refer to a combination of numerical or alphabetical sizes, such a small-medium (S-M), or large to extra-large (L-XL), or any other combination of consecutive sizes. Also, the pair of pants described herein may be without a general size and may alternatively be tailored or handmade on an individual basis and specifically tailored to an individual's body dimensions.

Generally, the padded shapewear garment device is manufactured of a neoprene, closed-cell foam, closed-cell silicone, polyamides, polyester-polyurethane, nylon, spandex, and/or combinations thereof, or any other suitable synthetic materials or combinations, as is known in the art. In yet another embodiment, the padded shapewear garment device comprises a plurality of indicia.

In yet another embodiment, a method of lifting, smoothing, and protecting the hips and buttocks of a user is disclosed. The method includes the steps of providing a padded shapewear garment device comprising a relaxed-fit pair of padded pants with contoured padding built into the lining. The method also comprises choosing a specific style and design of the padded pants. Further, the method comprises inserting a user's legs into the leg openings of the padded pants. Finally, the method comprises pulling the padded pants up over a user's hips and buttocks, which positions the contoured padding in place around a user's hips and buttocks.

Numerous benefits and advantages of this invention will become apparent to those skilled in the art to which it pertains, upon reading and understanding the following detailed specification.

To the accomplishment of the foregoing and related ends, certain illustrative aspects of the disclosed innovation are described herein in connection with the following description and the annexed drawings. These aspects are indicative, however, of but a few of the various ways in which the principles disclosed herein can be employed and are intended to include all such aspects and their equivalents. Other advantages and novel features will become apparent from the following detailed description when considered in conjunction with the drawings.

DETAILED DESCRIPTION OF THE PRESENT INVENTION

The innovation is now described with reference to the drawings, wherein like reference numerals are used to refer to like elements throughout. In the following description, for purposes of explanation, numerous specific details are set forth in order to provide a thorough understanding thereof. It may be evident, however, that the innovation can be practiced without these specific details. In other instances, well-known structures and devices are shown in block diagram form in order to facilitate a description thereof. Various embodiments are discussed hereinafter. It should be noted that the figures are described only to facilitate the description of the embodiments. They are not intended as an exhaustive description of the invention and do not limit the scope of the invention. Additionally, an illustrated embodiment need not have all the aspects or advantages shown. Thus, in other embodiments, any of the features described herein from different embodiments may be combined.

As noted above, there is a long-felt need in the art for a padded shapewear garment device that provides users with an improved padded garment without the bulk. There is also a ong-felt need in the art for a padded shapewear garment device that protects the hips and buttocks of the user from falls. Further, there is a long-felt need in the art for a padded shapewear garment device that protects the hips and buttocks of the users and is discrete and stylish in appearance. Moreover, there is a long-felt need in the art for a device that protects the hips and buttocks of the user and also provides a shapewear effect to the user. Further, there is a long-felt need in the art for a padded shapewear garment device that provides a garment with a contoured padding built into the interior of the pants. Finally, there is a long-felt need in the art for a padded shapewear garment device that also includes side pockets.

The present invention, in one exemplary embodiment, is a novel padded shapewear garment device. The device comprises a pair of padded pants. The pants are preferably relaxed-fit pants made from a flexible fabric material. The device comprises contoured padding built into the lining of the pants. Typically, the padding is positioned on the buttocks and hip areas of the pants. The padding also offers shaping or shapewear benefits to the user and may encircle the entire hip areas. Further, one embodiment of the device comprises a pair of padded pants with side pockets. The present invention also includes a novel method of lifting, smoothing, and protecting the hips and buttocks of a user. The method includes the steps of providing a padded shapewear garment device comprising a relaxed-fit pair of padded pants with contoured padding built into the lining. The method also comprises choosing a specific style and design of the padded pants. Further, the method comprises inserting a user's legs into the leg openings of the padded pants. Finally, the method comprises pulling the padded pants up over a user's hips and buttocks, which positions the contoured padding in place around a user's hips and buttocks.

Referring initially to the drawings, FIG. 1 illustrates a perspective view of one embodiment of the padded shapewear garment device 100 of the present invention. In the present embodiment, the padded shapewear garment device 100 is an improved padded shapewear garment device 100 that is a device for lifting, smoothing, and protecting the hips and buttocks of a user. Specifically, the device 100 comprises a pair of padded pants 102 that comprises contoured padding 104 built into the interior 106 of the pants 102. The pants 102 are preferably relaxed-fit pants made from a flexible fabric material. Typically, the padding 104 is positioned on the buttocks 300 and hip 200 areas of the pants 102. The padding 104 also offers shaping or shapewear benefits to the user 600 and may encircle the entire hip areas 200.

The intention of this invention is to provide a garment device 100 with compact and contoured cushioning/padding 104 and shaping and/or shapewear 108 around the hips 200 and buttocks 300 of a user 600, which is built into the interior 106 of the pants garment device 100. The exterior 110 of the garment will, in most cases, look like any other pair of pants 102. Styling embellishments, designs, and/or decorations 112 will serve as decoration only. The interior construction of the contoured padding 104 and shapewear 108 will remain the focus of the invention.

For example, any suitable designs and/or embellishments 112 can be utilized as is known in the art, such as stripes, polka dots, chevron, flowers, lace, stitching, etc. Additionally, the pants 102 can be any suitable color, design, print, or style as is known in the art, depending on the needs and/or wants of a user 600. Specifically, the styles of the pants 102 will change with the seasons, but this will have no bearing on the invention (i.e., the addition of the contoured padding 104 and the shapewear 108).

In another embodiment, respective hip or side pockets 114 are located circumferentially around the hip regions 200 of the pants 102 and are attached at the hip regions 200. Each hip region pocket 114 has a bottom end 116 secured to a respective pant leg 118 and has a respective top end 120 secured at the hip regions 200 or waistband 124. Each hip region pocket 114 has a respective opening 122 at its top end 120. Any suitable number of pockets 114 can be utilized as is known in the art, depending on the needs and/or wants of a user 600. Further, the pockets 114 can be positioned in any suitable place on the pants 102 as is known in the art.

As shown in FIGS. 2-3, the pair of pants 102 comprises a front side 202, a back side 204, a top 206, a bottom 208, an interior 106 and an exterior 110. The top 206 of the pair of pants 102 comprise an opening 210 for a user 600 to insert their legs and pull up the pants 102 around their waist. Specifically, the pair of pants 102 has a hip region 200 and the top 206 of the pants 102 and/or waistband 124 may be elastic to hold the pants 102 up. In one embodiment, there may be a drawstring at the top 206 of the pants 102 for securing them or a button or zippered fly. Alternatively, a belt or suspenders or the like may be used, depending on the needs and/or wants of a user 600.

Further, the bottom 208 of the pants 102 comprise a pair of leg openings or pant legs 118 for a user 600 to insert their legs during use. The leg openings/pant legs 118 can be any suitable size as is known in the art, and can be boot cut, straight leg, flared, tapered, etc., depending on the needs and/or wants of a user 600. The leg openings/pant legs 118 can be cropped, capri-length, floor-length, ⅞th length, ankle-length, etc., depending on the needs and/or wants of a user 600.

Additionally, the contoured padding 104 is strategically positioned in the interior 106 of the pants 102 and stitched using flatlock stitching (or any other suitable stitching), into the inside of the hips 200 and buttocks 300 areas of a user 600. The thickness of the contoured padding 104 will vary, as different areas of the padding 104 will have different thicknesses, based on positioning of the padding 104 within the garment (i.e., pants 102). For example, the contoured padding 104 would be thickest right at the base of the hips 200 and then thin out as the padding 104 goes down the user's leg. Further, the contoured padding 104 would be thickest right at the middle of the buttocks 300 area and then thins out as the padding 104 goes down.

Specifically, the contoured hip padding 104 is shaped to rest on and to protect the hip areas 200 and is shaped to provide such support as to diffuse impact over the entire hip area 200 and thereby minimize damage or injury to the user 600 during falls or accidents. Further, the contoured padding 104 is also shaped to rest on and to protect the buttocks area 300 and is shaped to provide such support as to diffuse impact over the entire buttocks area 300 and thereby minimize damage or injury to the user 600 during falls or accidents.

The contoured padding 104 selected for the preferred illustrated pair of padded pants 102 are any padding 104 that will provide suitable protection. A preferred material is a military grade silicone rubber that is available commercially, but is not required, and other suitable materials can be used to form the padding 104. Further, other shapes and sizes of the padding 104 may be selected for a particular user 600 or by a manufacturer as is known in the art.

As shown in FIG. 4, the contoured padding 104 is sandwiched between two layers 400 and 402 of fabric, which has four-way stretch, is breathable, washable, and compatible with the fabric that is used to manufacture the pants 102, i.e., cotton/spandex, cotton/lycra, etc.

In one embodiment, the pants 102 can include inserts 404 that are filled with gel, air, foam, or other material to create a padded area. The padded areas may be placed in several locations throughout the garment 102. These areas are considered to be where stress/force is applied to body parts, such as the knees, buttocks, and hips. The inserts 404 may be sewn/attached to the interior 106 of the garment 102 and may not be visible on the exterior 110. The exact specifications may vary.

In another embodiment, the garment 102 includes a plurality of pockets 406 located on the interior surface 106 of the garment 102. The plurality of pockets 406 are strategically placed on the garment 102 such that padded inserts 404 can be inserted into the plurality of pockets 406. The garment 102 holds the at least one padded insert 404 against the targeted area of the body of the user/wearer 600. The at least one padded insert 404 is concealed within the garment 102. The inner surface 106 is adjacent to the body of the user/wearer 600 during an in-use condition.

Further, the at least one padded insert 404 may include gel, air-padding, foam, or any other suitable form of padding or be inflatable. The at least one padded insert 404 minimizes friction on the targeted area of the body. Additionally, the at least one padded insert 404 comprises a substantially similar profile to a respective one of the plurality of pockets 406, such that the at least one padded insert 404 friction fits within one of the plurality of pockets 406 to minimize relative movement between the at least one padded insert 404 and the respective one of the plurality of pockets 406. Each of the at least one padded insert 404 is friction fit and compressed within a corresponding one of the plurality of pockets 406 during the in-use condition. The at least one padded insert 404 may be removeable or fastened via fastening means to the inner surface, as well. The fastening means may include sewing or other suitable fastening means as is known in the art.

As shown in FIG. 5, the pair of pants 102 also comprises a unique geometric construction and includes a plurality of layers that may vary in shape or compression strength creating at least one shapeware area 108. Specifically, the pair of pants 102 is made from multiple overlapping layers of at least one elastic or stretchable material and includes a plurality of seams which attach the multiple layers along the seams, thereby defining the compression or shapeware areas 108.

Any combination of suitable elastic and/or stretchable material(s) may be used to form the multilayer body or shapewear area 108. By being elastic or stretchable, the material is capable of stretching at least in a longitudinal direction when a force is applied to a portion of a wearer's body weight, while also being able to recover and/or return to the original shape and/or configuration when the force is removed. In embodiments, the materials that form the main body of the shapewear area 108 may include, but not be limited to, sheets of polyamides, including nylon, and polyester-polyurethanes, such as spandex, and combinations thereof, or any other suitable materials as is known in the art.

In some embodiments, the shapewear areas 108 may include multiple layers of the same material, i.e., polyamide, polyester-polyurethane, nylon, spandex, and/or combinations thereof. In other embodiments, the shapewear areas 108 includes multiple layers of different materials, i.e., a first layer of nylon and a second layer of spandex and/or a first layer of a nylon/spandex blend having a first concentration of nylon, and second layer of a nylon/spandex blend having a different concentration of nylon.

As shown in FIG. 6, after the pants 102 are put on, the pants 102 can be worn in their normal condition and the presence of the contoured pads 104 and shapewear 108 is not readily visible, due to the appropriate shaping and contour of the pads 104. Thus, the illustrated pants 102 may have the appearance of conventional pants without padding or shapewear, as the padding 104 and shapewear 108 is contoured to the shape of the pants 102.

In addition, the pair of pants 102 may be available in any size as defined by standardized sizing systems or catalog sizes, and usually denoted on a tag or label affixed to garments that are sold off-the-shelf. In the United States, garment sizes are typically denoted numerically (i.e., 0, 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 22, 24, etc.) or alphabetically (i.e., extra-small (XS), small (S), medium (M), large (L), extra-large (XL), double extra-large (XXL), triple extra-large (XXXL), etc.). Also, the pair of pants 102 described herein may be without a general size and may alternatively be tailored or handmade on an individual basis and specifically tailored to an individual's body dimensions.

Generally, the padded shapewear garment device 100 is manufactured of a neoprene, closed-cell foam, closed-cell silicone, polyamides, polyester-polyurethane, nylon, spandex, and/or combinations thereof, or any other suitable synthetic materials or combinations, as is known in the art.

In yet another embodiment, the padded shapewear garment device 100 comprises a plurality of indicia 602. The pair of pants 102 of the device 100 may include advertising, trademark, or other letters, designs, or characters, printed, painted, stamped, or integrated into the pair of pants 102, or any other indicia 602 as is known in the art. Specifically, any suitable indicia 602 as is known in the art can be included, such as, but not limited to, patterns, logos, emblems, images, symbols, designs, letters, words, characters, animals, advertisements, brands, etc., that may or may not be clothes or brand related.

FIG. 7 illustrates a flowchart of the method of lifting, smoothing, and protecting the hips and buttocks of a user. The method includes the steps of at 700, providing a padded shapewear garment device comprising a relaxed-fit pair of padded pants with contoured padding built into the lining. The method also comprises at 702, choosing a specific style and design of the padded pants. Further, the method comprises at 704, inserting a user's legs into the leg openings of the padded pants. Finally, the method comprises at 706, pulling the padded pants up over a user's hips and buttocks, which positions the contoured padding in place around a user's hips and buttocks.

Certain terms are used throughout the following description and claims to refer to particular features or components. As one skilled in the art will appreciate, different users may refer to the same feature or component by different names. This document does not intend to distinguish between components or features that differ in name but not structure or function. As used herein “padded shapewear garment device”, “shapewear garment device”, “garment device”, and “device” are interchangeable and refer to the padded shapewear garment device 100 of the present invention.

Notwithstanding the foregoing, the padded shapewear garment device 100 of the present invention can be of any suitable size and configuration as is known in the art without affecting the overall concept of the invention, provided that it accomplishes the above-stated objectives. One of ordinary skill in the art will appreciate that the padded shapewear garment device 100 as shown in FIGS. 1-7 are for illustrative purposes only, and that many other sizes and shapes of the padded shapewear garment device 100 are well within the scope of the present disclosure. Although the dimensions of the padded shapewear garment device 100 are important design parameters for user convenience, the padded shapewear garment device 100 may be of any size that ensures optimal performance during use and/or that suits the user's needs and/or preferences.

Various modifications and additions can be made to the exemplary embodiments discussed without departing from the scope of the present invention. While the embodiments described above refer to particular features, the scope of this invention also includes embodiments having different combinations of features and embodiments that do not include all of the described features. Accordingly, the scope of the present invention is intended to embrace all such alternatives, modifications, and variations as fall within the scope of the claims, together with all equivalents thereof.

What has been described above includes examples of the claimed subject matter. It is, of course, not possible to describe every conceivable combination of components or methodologies for purposes of describing the claimed subject matter, but one of ordinary skill in the art may recognize that many further combinations and permutations of the claimed subject matter are possible. Accordingly, the claimed subject matter is intended to embrace all such alterations, modifications and variations that fall within the spirit and scope of the appended claims. Furthermore, to the extent that the term “includes” is used in either the detailed description or the claims, such term is intended to be inclusive in a manner similar to the term “comprising” as “comprising” is interpreted when employed as a transitional word in a claim.

Claims

1. A padded shapewear garment device for lifting, smoothing and protecting a hip area and a buttocks of a user, the padded shapewear garment device comprising:

a pair of pants having a contoured padding and a shapewear;
wherein the contoured padding is positioned on a buttocks area and a hip area of the pair of pants;
wherein the shapewear encircles the hip area; and
further wherein the pair of pants are relaxed-fit pants made from a flexible fabric material.

2. The padded shapewear garment device of claim 1, wherein the pair of pants comprise a plurality of designs.

3. The padded shapewear garment device of claim 2, wherein the pair of pants comprise at least one side pocket.

4. The padded shapewear garment device of claim 3, wherein the pair of pants comprise a front side, a back side, a top, a bottom, an interior and an exterior.

5. The padded shapewear garment device of claim 4, wherein the top of the pair of pants comprise an opening for a user to insert their legs and pull up the pair of pants around their waist.

6. The padded shapewear garment device of claim 5, wherein the opening comprises a waistband with elastic to hold the pair of pants up.

7. The padded shapewear garment device of claim 6, wherein the bottom of the pair of pants comprise a pair of pant legs.

8. The padded shapewear garment device of claim 7, wherein the contoured padding is positioned in the interior of the pair of pants and stitched into inside of the hip area and the buttocks area of the user.

9. The padded shapewear garment device of claim 8, wherein thickness of the contoured padding will vary, as different areas of the contoured padding will have different thicknesses, based on positioning of the contoured padding within the pair of pants.

10. The padded shapewear garment device of claim 9, wherein the contoured padding is shaped to rest on and to protect the hip area.

11. The padded shapewear garment device of claim 10, wherein the contoured padding is shaped to rest on and to protect the buttocks area.

12. The padded shapewear garment device of claim 11, wherein the pair of pants comprise a plurality of pockets within the interior and a plurality of padded inserts which are positioned within the plurality of pockets.

13. The padded shapewear garment device of claim 12, wherein the pair of pants comprise a plurality of layers that vary in shape or compression strength creating at least one shapeware area.

14. A padded shapewear garment device for lifting, smoothing, and protecting a hip area and a buttocks of a user, the padded shapewear garment device comprising:

a pair of pants comprised of a contoured padding and at least one shapewear area;
wherein the pair of pants comprise a front side, a back side, a top, a bottom, an interior and an exterior;
wherein the contoured padding is positioned on a buttocks area and a hip area of the pair of pants;
wherein the shapewear encircles the hip area;
wherein the contoured padding is positioned in the interior of the pair of pants and stitched into inside of the hip area and the buttocks area of the user;
wherein the pair of pants comprise a plurality of layers that vary in shape or compression strength creating the at least one shapeware area;
wherein the pair of pants can be worn in their normal condition and presence of the contoured pads and the shapewear is not readily visible, due to appropriate shaping and contour of the contoured padding and the shapewear; and
further wherein the pair of pants are relaxed-fit pants made from a flexible fabric material.

15. The padded shapewear garment device of claim 14 further comprising a plurality of indicia.

16. The padded shapewear garment device of claim 14, wherein the pair of pants comprise at least one side pocket.

17. The padded shapewear garment device of claim 14, wherein the contoured padding is shaped to rest on and to protect the hip area.

18. The padded shapewear garment device of claim 14, wherein the contoured padding is shaped to rest on and to protect the buttocks area.

19. The padded shapewear garment device of claim 14, wherein the pair of pants comprise a plurality of pockets within the interior and a plurality of padded inserts which are positioned within the plurality of pockets.

20. A method of lifting, smoothing and protecting the hips and buttocks of a user, the method comprising the steps of:

providing a padded shapewear garment device comprising a relaxed-fit pair of padded pants with contoured padding built into the interior;
choosing a specific style and design of the padded pants;
inserting a user's legs into the leg openings of the padded pants; and
pulling the padded pants up over a user's hips and buttocks, which positions the contoured padding in place around a user's hips and buttocks.
