Description
CROSS-REFERENCE TO RELATED APPLICATIONS

This Application is a Continuation of U.S. patent application Ser. No. 11/253,968, titled “Compositions for Hair and Body Application” filed Oct. 19, 2005, which claims the benefit of U.S. Provisional Patent Application No. 60/522,603 filed on Oct. 19, 2004, the contents of which are incorporated herein by reference in their entirety.

FIELD OF THE INVENTION

The present invention relates to a composition and method for treating hair and skin and more particularly to a composition for application to hair and skin for repelling insects, for moisturizing and/or for repairing damage to skin, nails or hair.

BACKGROUND OF THE INVENTION

There are many grooming products on the market that either attract, or at least do not discourage, biting insects. This is particularly a problem for products intended for use on animals that are kept outdoors, such as horses, dogs, cats, and even birds. With the incidence and severity of insect-borne diseases on the rise, minimizing opportunities for insect contact is an important component of controlling and preventing such diseases. Products that are intended to address this problem may include added chemicals that act as an insect repellant but are toxic and can be harmful to animals and require humans to wear protective garments when applying. Currently, DEET (N,N,-diethyl-m-toluamide) is the active ingredient in most commercial topical insect repellents. Tests have shown that DEET provides effective and long-lasting protection against mosquitoes, however excessive use of DEET poses a risk of skin irritation or other adverse reactions. Further disadvantages of DEET include a limited spectrum of activity and a strong, unpleasant chemical odor. Also, DEET is a powerful plasticizer that can dissolve or mar plastic surfaces.

Efforts to develop natural insect repellents have been only partly successful. Such products include oils or citronella, turpentine, cedarwood, eucalyptus and wintergreen, however these have been relatively ineffective against many insects, and some may cause skin or eye irritation.

Accordingly, there is a need for a safe, non-irritating composition that can be applied to skin and hair that provides beneficial properties, such as moisturizing, while providing an insect repellent function.

SUMMARY OF THE INVENTION

It is an object of the present invention to provide a composition having insect repellent properties that is safe, non-irritating and effective.

It is another object of the present invention to provide compositions that impart benefits such as moisturizing and repair to hair, skin and other body areas to which they are applied.

In an exemplary embodiment, the inventive compositions comprise a deionized water base of weight percent ranging from 55% to 95.7%, 0.30 to 0.35 weight percent of one or more preservatives selected from the group consisting of DMDM hydantoin, methylparaben, and polyparaben, 0.05 to 0.10 weight percent of a chelating agent, 0.001 to 5.05 weight percent of one or more conditioners and/or moisturizers selected from the groups consisting of polyquaternium-10, polyethylene glycol derivative of lanolin, cetrimonium chloride, cetrimonium bromide, Crotein HKP™, mixed mucopolysaccharides, pyrrolidone carboxylic acid, propylene glycol, hydrolyzed keratin protein, aloe vera powder, 0.05 to 0.15 weight percent of an antioxidant selected from the group consisting of citric acid and vitamin E acetate. A preferred embodiment of the invention further comprises 0.01 to 0.23 weight percent of at least three botanicals selected from the group consisting of marigold extract, indian cress extract, rosemary extract, lavender extract, thyme, and clove. Further embodiments of the inventive composition include one or more anti-inflammatory agents, one or more antiseptics, stabilizers and emulsifiers. The composition, which is in liquid form, may be applied in the form of a spray or mist, by dipping the affected area in the liquid, or by pouring a small amount of the liquid into the hand for application or directly onto the affected area.

The inventive composition for use as an insect repellent provides the described benefits while using only natural ingredients that are safe and effective for their intended purpose. The composition, when mixed as described herein provides a natural insect repellent without the noxious smell and toxic vapors often associated with repellants known in the art. The other claimed compositions provide grooming benefits such as shine, detangling, and hair thickening. The inventive compositions contain primarily natural products and no insecticides and yet provide substantial insect repellent. The inventive compositions are useful and intended for use on most animals, including humans and domestic animals such as horses, dogs, cats and birds.

The embodiments of the invention include an insect repellant, a hair, coat and nail rebuilder, a daily shampoo, a hair and skin moisturizer, a conditioner and/or detangler.

DESCRIPTION OF THE PREFERRED EMBODIMENTS

It has long been known by gardeners that the strategic placement of marigolds among other plants in a garden can help protect the other plants. A first exemplary embodiment of the present invention, the formula for which is provided in Example 1 below, is sold commercially under the trademarks Marigold Spray™ and Mega Marigold™ is a composition that includes marigold extract (synonyms: Calendula extract; Calendula officinalis Linn., extract; Calendula officinalis extract) and other natural botanical extracts that create a physical barrier to flies, mosquitoes, and gnats. The inventor has conducted exhaustive testing using natural ingredient fly sprays containing marigold extract and has found these to be the best product for horses with sensitive skin, young horses, and horses that don't wear fly masks. The inventive composition is so gentle that there are no concerns about spraying the horse's face since it will not burn a horse's eyes, and it is not sticky, so it does not attract and adhere dust to the treated area. Marigold Spray™ is a non-toxic spray that can be used safely on a horse's head and ears. The present invention may also be used on other domestic animals, including dogs and cats. The present invention is further considered safe for human use and may be used on the body and the face, since there are no harmful or irritating chemicals. The formula of the first embodiment includes conditioners and moisturizers, providing additional benefits beyond its insect repellant quality.

A second embodiment, the formula for which is provided in Example 2 below, is a natural botanical moisturizing liquid composition that may be used on humans as well as horses, and other domestic animals, such as dogs and cats. The composition, which may be applied as a spray to hair and skin, does not contain polymers, silicone, oil, or alcohol. The moisturizing liquid attracts moisture and binds it to the hair. Tests have shown that it attracts as much as twenty times the amount of moisture in the composition itself and lasts for as long as 24 hours.

When used on humans, the natural botanical moisturizing spray enhances hair health, protecting it from sun and heat from hair dryers, curling irons, etc. The liquid composition shines, detangles, is anti-static, is soothing and does not burn. It can be used as an aftershave on the face for men or on women's legs. Women may mist it on the face before applying makeup, allow it dry, then apply makeup and mist again. The improved moisture retention capability provided by the formula causes the makeup to last much longer than when applied to untreated skin.

For pets, the natural botanical formula may be used whenever a pet is bathed or brushed. The spray does not coat or damage the animal's skin or hair. If the hair is not coated with oil, moisture passes down to the base of the hair to the skin, allowing the skin to breathe more easily. The spray is not sticky, greasy or slippery, so it does not attract and adhere dirt and dust. The natural botanical formula is non-toxic and environmentally friendly, hypoallergenic, and it will not burn the eyes. The formula conditions and moisturizes the coat, prevents dry skin conditions, promotes healthy skin and coat, detangles mane and tail, and enhances color.

A third embodiment of the present invention, the formula for which is provided in Example 3 below, is an oil-free, silicone-free, leave-on conditioning detangler that maintains the moisture balance within the hair shaft. This liquid composition may be applied in a mist form for humans as well as horses and other domestic animals, such as dogs and cats. This formula prevents the hair from becoming dry, brittle, and breaking off, without the use of oil, silicone, wax, or synthetic polymers. It shines and conditions the hair or coat with a formula that combines the extracts of avocado and aloe vera. The composition detangles without the heaviness common in most conditioners and promotes shine and eases manipulation of the hair. This formula may be a wet or dry leave-on spray that is excellent for long hair. Treatment with this mist leaves the hair anti-static and it stops flyaways.

A fourth embodiment of the present invention, which is described in Example 4 below, is a natural botanical shampoo that may be used on humans as well as horses and other domestic animals, such as dogs and cats. In humans, the shampoo extends the life of color treated hair, makes perms last longer, and removes chlorine from the hair, which can turn the hair green if the person swims frequently in a pool. The shampoo helps eliminate dry, flaky skin, and enhances hair color. The shampoo contains no synthetic polymers, wax, oil, silicone, harsh detergents or alcohol, and easily rinses clean, leaving no residues, and lets the hair accept moisture from the air. The shampoo is non-toxic, environmentally friendly and does not contain diethanolamine (DEA).

When used on animals, the coat dries up to fifty percent faster. With horses, the shampoo leaves the hair shaft completely clean, not coated with wax, oil, petroleum by-products, silicone, or synthetic polymers, thereby allowing the hair to accept more moisture from the air. This allows horses to cool out up to fifty percent faster.

A fifth embodiment of the present invention, the formula for which is provided in Example 5 below, is a rebuilder that may be used on humans as well as horses and other domestic animals, such as dogs and cats. In humans, the rebuilder makes the hair thirty percent stronger so that less hair falls out and the hair will be thicker and fuller. The present invention has been used by chemotherapy patients and by people who are experiencing hair loss due to high blood pressure medication. The present invention has been found to make finger nails thirty percent stronger, and may be used as a moisturizer for dry, calloused hands. In pets, the rebuilder strengthens and repairs dry, damaged coats and cracked paw pads, and corrects the structure of weakened, dry damaged coats and paw pads. The rebuilder stimulates and promotes rapid hair and paw pad repair without the use of silicone, synthetic polymers, oils, or petroleum based products. The rebuilder binds protein to the coat, returning elasticity and restoring strength, removing damaging toxins, medications, and chemical residues. It detangles severely matted hair and is safe to use on dry noses. In horses, it strengthens hair so the hair in the mane and tail won't break off easily and it makes the hair healthier and stronger. It also makes hooves grow from 10% to 50% faster and makes them 30% stronger. Sand cracks are reduced, quarter cracks heal faster, and shoes hold better. The composition is especially helpful for treating shelly-footed horses. The rebuilder is environmentally friendly and non-toxic.

The compositions of the present invention may also contain as adjuvant materials various substances, such as vitamins, lanolin or its derivatives, bactericides, plant extracts, coloring agents, perfumes, thickeners, buffers, surface active agents, and sequestering agents.

For purposes of the description of the prevent invention, the following definitions are used:

“Cationic surface active agents” are those surface active detergent compounds which contain an organic hydrophobic group and a cationic solubilizing group. Typical cationic solubilizing groups are amine and quaternary groups. Quaternary ammonium compounds typically contain an alkyl group of 1 to 30 carbons linked to a nitrogen atom and three alkyl groups containing 1 to 3 carbons or other alkyl groups bearing inert substituents such as phenyl groups. Typical quaternary ammonium detergents are benzyl dimethyl stearyl ammonium chloride (stearalkonium chloride), ethyl dimethyl stearyl ammonium chloride, trimethyl stearyl ammonium chloride, dimethyl ethyl lauryl ammonium chloride, and others.

“Suspending agents or emulsifiers” in the present invention can be any of several long chain acyl derivatives having about 1 to 30 carbon atoms, or mixtures thereof including but not limited to the glycol ester glyceryl stearate.

“Esterified forms of vitamins” may have 1 to 30 carbons and alcohols may have 1 to 30 carbons.

The compositions of the present invention are explained more specifically with reference to the following preparation and formulation examples. The compositions are created in volume by combining the ingredients listed in the examples below.
